Copies of correspondence, briefings, reports, presentations, meeting records or advice exchanged with the Scottish Government, Healthcare Improvement Scotland or another body concerning:

  1. restrictions upon which practitioners may perform specified procedures;
    b. requirements to operate from HIS-registered premises;
    c. the presence of an authorised prescriber or healthcare professional;
    d. procedure classification or risk categorisation; and
    e. the public health evidence supporting these proposals.

Copies of comparative complication, injury, infection, hospital-treatment, enforcement or mortality data held or supplied concerning procedures performed by:

  1. independent aesthetic practitioners;
    b. doctors, dentists, nurses, pharmacists or other statutory healthcare professionals; and
    c. different practitioner or professional groups.

For any data provided under point 2, please supply records explaining:

  1. the source of the data;
    b. the period covered;
    c. the number of incidents recorded;
    d. how practitioner status was identified;
    e. whether complications were independently verified;
    f. whether the procedure was identified;
    g. whether the procedure was performed lawfully; and
    h. any limitations affecting comparison between practitioner groups.

Copies of any research, literature review, evidence assessment or data analysis undertaken or commissioned by Public Health Scotland concerning the safety of non-surgical cosmetic procedures.

Copies of any recorded assessment of whether professional registration as a healthcare professional is associated with lower complication or injury rates when performing the affected procedures.

Copies of records concerning whether Public Health Scotland was asked to provide evidence or advice for:

  1. the Scottish Government consultation;
    b. the consultation analysis;
    c. the Scottish Cosmetic Interventions Expert Group;
    d. the Business and Regulatory Impact Assessment;
    e. the Equality Impact Assessment;
    f. the Non-surgical Procedures and Functions of Medical Reviewers (Scotland) Bill; or
    g. the proposed secondary legislation.

Copies of records concerning the number or participation of practising independent aesthetic practitioners directly involved in developing the regulatory proposals, excluding people who only submitted an open public consultation response.

Copies of records received concerning the role, status, authority or representative standing of:

  1. the Joint Council for Cosmetic Practitioners;
    b. Save Face Limited;
    c. BABTAC;
    d. the British Beauty Council; and
    e. the Scottish Medical Aesthetics Safety Group.

Copies of records showing whether Public Health Scotland considered:

  1. whether JCCP is a voluntary register rather than a statutory professional regulator;
    b. whether Save Face is a private limited company operating a practitioner register and referral service;
    c. the distinction between Professional Standards Authority accreditation and statutory regulation;
    d. overlapping trustee, board, advisory or committee roles involving organisations contributing to the proposals; and
    e. declarations or possible conflicts of interest.

Copies of any assessment of the possible public health effects of the proposed requirements, including:

  1. displacement of procedures into unregulated or informal settings;
    b. reduced reporting of complications;
    c. changes in treatment availability;
    d. geographical inequalities in access to regulated premises;
    e. effects upon rural and island communities; and
    f. whether practitioners or clients may travel elsewhere to obtain procedures.

Copies of any representations, recommendations or concerns submitted by Public Health Scotland to the Scottish Government, HIS or another body concerning the evidence base, proportionality or implementation of the proposals.

Please identify any Public Health Scotland directorate, team, committee or officer responsible for considering non-surgical cosmetic procedures or contributing to the relevant policy work.
