“During COVID-19, the Scottish Government issued guidance recommending measures such as mask-wearing, social distancing, and testing in schools. It is very clear that this guidance does not grant authority to impose such measures without the consent of parents or children.

Under the Freedom of Information (Scotland) Act 2002, I request the following:

  1. Definitive documentation that grants Scottish regional councils the authority to enforce mask-wearing in schools without parental or child consent.
  2. Details on how this authority was established, including any legal or statutory basis, and how such authority aligns with or circumvents human rights obligations.
  3. Specifically, please address compliance with Article 6 of the Universal Declaration on Bioethics and Human Rights (UDBHR), which emphasizes informed consent as a fundamental principle, and other relevant human rights provisions. Additionally, provide information on how and when these rights were officially dispensed with.”
